I have an inquiry about blacklisting. Here's the narrative below:
Hired: As HR expert level 1
Recruited via Agency
Probationary: 6 months
Start date: June 18, 2018
1st month: June 18 - July 18: completed online courses
2nd month: July 19 - Aug 19:
1st half of the month wait for US visa
2nd half of the month, sent to US for HR training
(= 2 weeks only from Aug 5-16)
3rd month: Aug 20 - Sept 24: In post training, process transactions
Sept 25: Provide NTE memo due to client feedback of #'s of cases with complaint
Said preventive suspension is in effect.Confiscated laptop due to preventive suspension
Sept 28: with the 5 calendar rule, provided NTE reply (to defend cases in question of complaint)
Oct: 5 They have made the decision of dismissal
oct 11-17: calling me for a RTWO.
Just to issue dismissal
Reply via email. Will not sign dismissal
Due to investigation result was not provided during Notice of Decision.
Last week of Oct: HR payroll call me to secure final clearance.
Question: based from the series of events, can I blacklist the few HR personnel who processes the dismissal (all whose signature were stamped in the decision)
Reason:
- I consulted DOLE, the mere reason that they provide me the written notices w/c made them compliant;
But has not provided the Investigation Results to justify my dismissal were not provided.
I have asked for these results;
I have not received via email or mail.
Not even attached in the Notice of Decision
Ex: Audit form of transaction number/s, Audit score, Coaching Logs, Rolled out communication of KPI metrics
- DOLE quoted: Even the employee has claimed the full & final pay plus clearances, he/she can still file for NLRC case
Only if employee has been verified by previous employer of "ineligible for rehire"
Causing the ex-employee not valid for employment by companies possible for job offers.
Justification: I have asked the question of blacklisting due to the notion that persons who are in the Leadership.
"management prerogative reasons" are not absolute in terms of Investigation/technical results were not given to the dismissed employee.
The moment, they filed a complaint and prevent them to earn, economically sabotage the person.
Though they may pay for the authorized/just causes,
The impact of what they have done to employees' lives are not worth of them staying as HR personnel in the industries they currently practice their profession.

So what I think is going on here is that this person is in the Philippines and is wanting the NLRC/DOLE (nlrc.dole.gov.ph) to sanction the company that fired them because they believe it was done in some unlawful way. That makes this question basically a Philippines legal question and off topic here.

I am sure this makes sense to you, but I can’t tell if you got fired, or you fired someone else, or you work in HR; if you did something egregious which involved you being abruptly terminated, or if there was a performance improvement plan? This is an almost nonsensical stream of random words.
